On April 21, 2010, the Ministry of Commerce issued announcement No. 15 of 2010, deciding to impose anti-dumping duties on imported nylon 6 chips originating in the United States, the European Union, Russia and Taiwan. On April 21, 2016, the Ministry of Commerce issued announcement No. 4 of 2016, which decided to continue to impose anti-dumping duties on imported nylon 6 chips originating in the United States, the European Union, Russia and Taiwan from April 22, 2016 for a period of five years. On March 15, 2017, the Ministry of Commerce issued announcement No. 14 of 2017, deciding that gubishev nitrogen Public Co., Ltd. shall inherit the anti-dumping duty rate of 5.9% and other rights and obligations applicable to gubishev nitrogen open-end joint stock company in the anti-dumping measures for nylon 6 chips. On July 20, 2017, the Ministry of Commerce issued announcement No. 34 of 2017, deciding to adjust the anti-dumping duty rate of Lucent Germany Co., Ltd. and Lucent Belgium Co., Ltd. from 23.9% to 8.2%. On June 8, 2018, the Ministry of Commerce issued announcement No. 47 of 2018, which decided to inherit the 36.2% anti-dumping duty rate and other rights and obligations of Honeywell resin and Chemicals Co., Ltd. in the anti-dumping measures of nylon 6 chips. On July 6, 2020, the Ministry of Commerce issued announcement No. 24 of 2020, which decided that DSM engineering materials company should inherit the 8.2% anti-dumping duty rate and other rights and obligations applicable to DSM engineering plastics in the anti-dumping measures for nylon 6 chips.
On January 29, 2021, the Ministry of Commerce issued announcement No. 3 of 2021. According to the announcement, after the end of the transition period of brexit on December 31, 2020, the trade remedy measures already implemented for the EU will continue to apply to the EU and the UK with the implementation period unchanged; After that date, the UK will no longer be treated as a member of the EU in the case of trade remedy investigation and review initiated by the EU.
On January 28, 2021, the Ministry of Commerce received from Fujian Yongrong Jinjiang Co., Ltd., Changle Liheng nylon Technology Co., Ltd., Haiyang Technology Co., Ltd., Jiangsu Haiyang nylon New Material Co., Ltd., Hangzhou Yichen Chemical Fiber Co., Ltd., Fujian Zhongjin New Material Co., Ltd., Guangdong Xinhui Meida nylon Co., Ltd., Zhejiang Fangyuan New Material Co., Ltd 11 mainland application enterprises including Hunan Yuehua Chemical Co., Ltd., Changle Hengshen synthetic fiber technology Co., Ltd. and Zhejiang Huajian nylon Co., Ltd., as well as two supporting enterprises including Hangzhou jushun New Material Co., Ltd. and Zhejiang Hengyi nylon Co., Ltd., submitted the application for final review of anti-dumping measures on behalf of the nylon 6 chip industry in mainland China. The applicant claims that if the anti-dumping measures are terminated, the dumping of imported nylon 6 chips originating in the United States, the European Union, Russia and Taiwan may continue or recur, and the damage to the industries in mainland China may continue or recur, and request the Ministry of Commerce to rule to maintain the anti-dumping measures against nylon 6 chips originating in the United States, the European Union, Russia and Taiwan Anti dumping measures for imported nylon 6 chips from Russia and Taiwan. The application for final review does not include the United Kingdom, and the anti-dumping measures applicable to imported nylon 6 chips originating in the United Kingdom will be terminated from April 22, 2021.
In accordance with the relevant provisions of the anti dumping regulations of the people's Republic of China, the Ministry of Commerce has examined the applicant's qualification, the relevant information about the products under investigation and the similar products in mainland China, the import situation of the products under investigation during the implementation of anti-dumping measures, the possibility of dumping continuing or recurring, the possibility of injury continuing or recurring, and relevant evidence. The existing evidence shows that the applicant meets the provisions of Articles 11, 13 and 17 of the anti dumping regulations of the people's Republic of China on industry and industry representativeness, and is qualified to apply on behalf of the nylon 6 chip industry in mainland China. The investigating organ holds that the claim and the prima facie evidence submitted by the applicant meet the requirements of the final review.
According to Article 48 of the anti dumping regulations of the people's Republic of China, the Ministry of Commerce has decided to conduct a final review investigation on the anti-dumping measures applicable to imported nylon 6 chips originating in the United States, the European Union, Russia and Taiwan from April 22, 2021. The relevant matters are hereby announced as follows:
1. Continue to implement anti-dumping measures
According to the proposal of the Ministry of Commerce, the Tariff Commission of the State Council has decided to continue to levy anti-dumping duties according to the scope and rate of taxable products announced by the Ministry of Commerce No. 15 in 2010 and No. 34 in 2017 during the final review of anti-dumping measures. The current anti-dumping duty rates of each company are listed in the annex to this announcement.
2、 Review investigation period
The dumping investigation period of this review is from October 1, 2019 to September 30, 2020, and the industrial injury investigation period is from January 1, 2016 to September 30, 2020.
3. Review the product range
The scope of products to be reexamined is the products to which the original anti-dumping measures are applicable, which is consistent with the product scope of Announcement No. 15 of 2010 of the Ministry of Commerce. The details are as follows:
Product Name: Nylon 6 chips, scientific name polycaprolactam, also known as polyamide-6 chips or nylon 6 chips.
English Name: polycaprolactam, polyamide-6 (PA6 for short), Nylon6.
Chemical formula: - [NH - (CH2) 5-CO] n -
Physical and chemical characteristics: Nylon 6 chip is a kind of crystalline polymer with milky white or yellowish appearance, translucent to opaque, soluble in phenol and hot sulfuric acid.
Main uses: Nylon 6 chip has the characteristics of colorability, toughness, wear resistance, self lubrication, low temperature resistance, bacteria resistance, good molding and processing properties. It is a widely used synthetic resin, mainly used in chemical fiber, textile, chemical industry, electronics, machinery, automobile, military industry, food and medical fields.
The product belongs to the import and export tariff of the people's Republic of China: 39081012 [1].
4、 Review content
The content of this reexamination investigation is: if the anti-dumping measures against imported nylon 6 chips originating in the United States, the European Union, Russia and Taiwan are terminated, whether dumping and injury may continue or recur.
5、 Register for the survey
Interested parties may, within 20 days from the date of promulgation of this announcement, register with the trade remedy Investigation Bureau of the Ministry of Commerce to participate in the final anti-dumping review investigation. The interested parties participating in the investigation shall provide the basic identity information, the quantity and amount of the products under investigation exported or imported to the mainland of China, the quantity and amount of similar products produced and sold, and the related information, etc《 The reference format for registration to participate in the survey can be downloaded from the website of the trade remedy Investigation Bureau of the Ministry of Commerce.
Interested parties shall submit the electronic version through the "trade remedy investigation information platform" (http: / / ETRB. MOFCOM. 7、 Comments on case filing
Interested parties may submit their written comments to the trade remedy Investigation Bureau of the Ministry of Commerce within 20 days from the date of promulgation of this announcement if they need to comment on the product scope, applicant qualification, countries under investigation and other relevant issues.
8、 Investigation method
According to the provisions of Article 20 of the anti dumping regulations of the people's Republic of China, the Ministry of Commerce may use questionnaires, sampling, hearings, on-site verification and other means to obtain information from interested parties and conduct investigation.
In order to obtain the information needed for the investigation of this case, the Ministry of Commerce usually issues questionnaires to interested parties within 10 working days from the deadline for registration to participate in the investigation specified in this announcement. Interested parties can download the questionnaire from the website of the trade remedy Bureau of the Ministry of Commerce.
Interested parties shall submit complete and accurate answers within the specified time. The answer sheet should include all the information required by the questionnaire.
9. Submission and processing of information
When the interested parties submit comments and answers during the investigation, they shall submit the electronic version through the "trade remedy investigation information platform" (http: / / ETRB. MOFCOM. Gov.cn), and submit the written version according to the requirements of the Ministry of Commerce. The contents of the electronic version and the written version shall be the same, and the format shall be consistent.
If the information submitted by the interested party to the Ministry of Commerce needs to be kept confidential, it may make a request to the Ministry of Commerce for confidential treatment of the relevant information and explain the reasons. If MOFCOM agrees with its request, the interested party applying for confidentiality shall also provide a non confidential summary of the confidential information. The non confidential summary shall contain sufficient and meaningful information to enable other interested parties to have a reasonable understanding of the confidential information. If a non confidential summary cannot be provided, reasons shall be given. If the information submitted by the interested party does not indicate that it needs to be kept confidential, the Ministry of Commerce will regard the information as public information.
10、 Consequences of non cooperation
According to Article 21 of the anti dumping regulations of the people's Republic of China, when the Ministry of Commerce conducts an investigation, the interested parties shall truthfully report the situation and provide relevant information. If an interested party fails to truthfully reflect the situation and provide relevant information, or fails to provide necessary information within a reasonable time, or seriously hinders the investigation in other ways, MOFCOM may make a ruling based on the facts already obtained and the best information available.
11、 Investigation period
This investigation starts on April 22, 2021 and should be completed before April 21, 2022.
